Colorado Springs business owner to pay $400,000 fine over noise pollution

COLORADO SPRINGS, Colo. (KKTV) – A Colorado Springs business and its owner have agreed to pay $400,000 to the United States to settle allegations that they violated the False Claims Act.

Emad Yasa, owner of Dynamic, operates two clinics in Colorado Springs. Dynamic is a physical therapy company. According to the Justice Department, a former employee of Dynamic has filed a “pass-through” lawsuit alleging that Yasa is billing Medicare for medically unnecessary physical therapy services and improperly rendered services. Yasa signed a “procedural and final board order” alleging that between mid-2014 and mid-2017, “he routinely and improperly billed insurance companies, Medicare and Medicaid, for individual hydrotherapy sessions when his patients participated in group hydrotherapy sessions” and also “the patients in group hydrotherapy sessions.” They did not regularly record their participation in the sessions.

Under investigation in the United States, Dynamic submitted false claims to TRICARE.

US Attorney Cole Finnegan said: “We will aggressively pursue any health care provider who relies on fraud to obtain payment from our federal health care programs.” “We appreciate the efforts of whistleblowers who bring fraudulent billing practices to light.”

The claims resolved by the settlement are allegations only, and no determination of liability has been reached.
